5 Reasons Missouri Notary Education is Important
Knowledge is power!
- Protects the Public from Fraud and Error: A notary's most fundamental duty is to prevent fraudulent signatures and document execution. Proper education teaches the notary the mandatory steps for identity verification (like what constitutes "satisfactory evidence" in Missouri) and how to recognize red flags. Without this knowledge, the notary becomes a weak link, potentially allowing criminals to sign documents under false pretenses and causing enormous legal and financial harm to others.
- Ensures Compliance with State Law: Notary law is complex and specific to the state of Missouri (or any other state). Education ensures the notary knows the scope of their authority—what they can and cannot do.
- Mandatory Journal and Record Keeping: A notary journal is the official record of every act performed. Education covers the nine mandatory details that must be recorded for every entry, including the signer's information and the method of identity verification. Correct journal keeping ensures that if a document is ever challenged in court, the notary has the necessary proof of the transaction, which is vital for legal traceability and defending their actions.
- Differentiates Notarial Acts (Jurat vs. Acknowledgment): Many public members don't know the difference between the two primary acts. Misapplying the wrong notarial certificate can change the legal meaning of the entire document. Training teaches the notary how to choose the correct certificate and, if necessary, instruct the signer on what each act means.
- Limits the Notary's Personal Liability: Education minimizes mistakes, reducing the risk of being sued for negligence or misconduct. Knowing the rules—such as promptly reporting a lost seal or journal to the Secretary of State—is a crucial protective measure for the notary's career and personal finances.
